LIABILITY WAIVER RELEASE AND ASSUMPTION OF RISK AGREEMENT
1 Purpose and scope
This Liability Waiver, Release and Assumption of Risk Agreement (Agreement) applies to my participation in PAWS X YOGA classes, sessions, events, activities, and related services (collectively, Activities), including yoga or other movement, time spent in or around the event space, and interaction with puppies or other animals. “PAWS X YOGA” includes its owners, employees, instructors, contractors, volunteers, venue partners, puppy providers, animal handlers, and agents, to the extent permitted by law.
1A Ticket purchase and online acceptance
When this Agreement is presented at ticket checkout or through an online waiver process, the ticket purchaser must be given a clear opportunity to review it and must affirmatively indicate acceptance before completing the purchase. By completing that required acknowledgment and purchasing a ticket, the purchaser represents that the purchaser is the participant or is authorized to accept this Agreement for the identified participant(s). Each adult participant should complete or separately acknowledge this Agreement. For a participant age 6 through 14, the parent or legal guardian must provide the required consent. A purchase alone is not intended to replace any acknowledgment or signature required by applicable law.
2 Assumption of yoga and physical activity risks
I understand that yoga, stretching, movement, exercise, and related activities involve inherent risks. These may include muscle strain, sprains, falls, aggravation of a pre-existing condition, dizziness, fainting, cardiovascular or respiratory events, and other injury. I understand that I may choose to stop, rest, modify, or decline any activity at any time. I am responsible for consulting an appropriate health professional if I have a medical condition, injury, pregnancy, or other concern that could affect safe participation.
3 Assumption of puppy and animal interaction risks
I understand that puppies and other animals can behave unpredictably, even when supervised and handled with care. Risks may include scratching, nipping or biting, jumping, knocking someone over, accidental contact, damage to clothing or personal property, exposure to saliva, urine, feces, parasites, or other biological materials, and transmission of illness. I understand that puppies may be excitable, tired, fearful, or reactive. I voluntarily choose to participate with knowledge of these risks.
4 Allergies and health considerations
I understand that the event may involve exposure to animal dander, hair, saliva, dust, cleaning products, fragrances, latex, and other possible allergens or irritants. I am responsible for identifying my own allergies and health needs, bringing any required medication or equipment, and deciding whether it is safe for me to attend. I will immediately notify staff of any reaction, injury, or concern.
5 Personal responsibility and instructions
I agree to participate attentively, use reasonable judgment, and follow all posted rules and instructions from PAWS X YOGA staff, instructors, venue personnel, and puppy or animal handlers. I will treat puppies, other animals, and guests respectfully; I will not chase, corner, pick up, feed, tease, restrain, or otherwise handle a puppy or other animal unless specifically permitted and instructed. PAWS X YOGA may remove me from an Activity, without refund where permitted by applicable law, if it reasonably believes my conduct creates a safety, puppy or animal welfare, or disruption concern.
6 Release and hold harmless
To the fullest extent permitted by Illinois law, I voluntarily release and agree to hold harmless PAWS X YOGA from claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to my participation in the Activities, including claims based on ordinary negligence. This release does not apply to conduct that cannot lawfully be released, including gross negligence, willful or wanton conduct, or any other liability that Illinois law does not permit to be waived. Nothing in this Agreement is intended to limit rights or remedies that cannot legally be limited.
7 Medical and emergency authorization
I understand that PAWS X YOGA is not responsible for providing medical care. If I appear to need emergency assistance, I authorize PAWS X YOGA to contact emergency services and/or my emergency contact. I am responsible for any medical, transportation, or related costs incurred on my behalf. This authorization does not require PAWS X YOGA to provide care or create a duty beyond what the law requires.
8 Personal property
I am responsible for my personal belongings. To the fullest extent permitted by law, PAWS X YOGA is not responsible for loss of, theft of, or damage to personal property brought to an Activity, except to the extent caused by conduct for which liability cannot legally be waived.
9 Photo and video release
I understand that PAWS X YOGA may photograph, film, or record Activities. Unless I opt out below before the Activity begins, I grant PAWS X YOGA permission to use my likeness, voice, and image in photographs, video, or other recordings for lawful promotional, marketing, social media, archival, or educational purposes, without additional compensation. This permission does not authorize use that is unlawful or materially misleading.
If I do not consent to PAWS X YOGA using my likeness, voice, or image as described above, I understand I must notify event staff before the Activity begins.
10 Cancellations and rescheduling
I acknowledge that PAWS X YOGA may cancel, postpone, modify, or reschedule an Activity because of weather, venue conditions, animal welfare or availability, illness, safety concerns, or other circumstances. Any refund, credit, or transfer will be handled under the cancellation policy provided at booking or otherwise required by law. I understand that an event change does not increase PAWS X YOGA’s responsibilities beyond that policy and applicable law.
